What should be done about Canada’s assisted reproduction laws?

Source The Globe And Mail

Alison Motluk is a Toronto freelance journalistwith a special interest in assisted reproduction.

Recently, the Prime Minister suggested it might be time to revisit our law on assisted reproduction. He was responding to the news that Liberal MP Anthony Housefather planned to introduce a private member’s bill amending parts of the law that made it a criminal offence to pay people to act as surrogates, egg donors or sperm donors.

They are right that the Assisted Human Reproduction Act, which received royal assent in 2004, is a bit outdated. Much of it comes from a time before it was common for gay couples to have children, for lesbians to use anonymous sperm donors or for single women or men to create families on their own. The idea that paying for someone’s willing help in this could send a parent to prison doesn’t feel right.

Would-be mother who has battled cancer TWICE in her 20s is finally fulfilling her dream of starting a family using a surrogate – after chemo crushed her hopes of carrying a baby

Source Daily Mail

A young woman who has been diagnosed with both cervical and breast cancer all before turning 30 has revealed her plans to start a family with her fiance, with the help of a surrogate.

Still just 28, Helen Johnson, who says she has always ‘longed’ to be a mother, faced a double whammy, when she found a pea sized lump in her breast exactly a year after being diagnosed with cervical cancer.
Helen, from Bolton in Greater Manchester, froze her eggs after learning she had cervical cancer when she was 27, just 14 months after her first ever smear test – which was clear.

Here’s Why Pro-Life People Should be Concerned About Surrogacy and “Selective Reduction”

Source Life News

The reboot of the sitcom, “Roseanne,” has been met with accolades from many conservatives. They claim the popularity of the show is due to allegedly representing the values of Middle America. I have not watched the reboot because I wasn’t a fan of the original and I knew the storyline of the new show included a positive, or at least morally neutral portrayal of surrogacy. I may be mistaken, but I have yet to hear a single conservative pundit who praised the show express any moral concerns regarding the surrogacy. This unquestioned acceptance of surrogacy as a social good presents a moral crisis just as serious as surrogacy itself.

Gay people using a surrogate have to put time and effort into planning parenthood

Source DevonLive

I wish people who disapprove of the decision by Plymouth diver Tom Daley and his partner Dustin Lance Black to have a baby by surrogacy, would just shut up.

The most common criticism, apart from plain old prejudice, is that the baby will suffer from not having a mother.

Unlike some heterosexual couples who accidentally have babies, or decide on a whim, same-sex couples are almost certainly going to discuss and plan their children at length

Pro-life group tears into proposed changes to IVF law

Source Malta Today
The Life Network Foundation says new law will create ethical and legal problems for children born from in-vitro fertilisation

A pro-life group has raised concerns over proposed changes to the Embryo Protection Act, which it says gives short shrift to the legal and ethical issues involved.

Life Network Foundation chairperson, Miriam Sciberras, was critical of changes that will change the definition of prospective parents, the introduction of anonymous gamete donation and embryo freezing.

Sciberras also criticised the proposal to start a consultation process on altruistic surrogacy. She said surrogacy turned women into objects and ignored the importance of the bond that develops during pregnancy between the mother and the child.

The wider definition of parents would allow, among others, single women to make use of in-vitro fertilisation treatment. The changes also propose the introduction of anonymous sperm and egg donation.

The Surrogacy Bill 2016 and the recent Maharashtra State Commission for Protection of Child Rights ( MSCPCR) is silent on the fundamental right of child, that every infant including surrogate child born of surrogacy has right to breast feeding or similar substitutes in the interest of early growth, survival and development of child.

The MSCPCR issued guidelines this month on regulation of surrogacy for protection of interest of child born of surrogacy, the surrogate mother and to check any malpractices but the commission guidelines does not address the same. Considering the commission is a specialized body constituted under CPCR Act 2005 with the specific mandate to promote the best interest of child through its recommendations following review of existing legislations, policy, such oversight by commission is a glaring omission.

Malta – New bill will make IVF available to same-sex couples and single women, allow voluntary surrogacy

Source Times of Malta

The introduction of embryo freezing and adoption, access to IVF for same-sex couples and single persons, as well as a public consultation on surrogacy are the highlights of a new IVF bill presented this afternoon, by Health Minister Chris Fearne.

Addressing a news conference at Parliament, the deputy prime minister said the bill had been unanimously approved by the Labour Party.
He said that until the final few months of the Gonzi administration in 2012, there was no regulation of IVF.

“The 2012 law was a good move, but time is ripe to move further ahead,” he said.
He explained that between 18 to 20 per cent of couples faced infertility problems.

Under this bill IVF will be also be offered to same sex couples as well as single women.

A 29-year-old mother has spoken candidly about her gracious decision to help couples struggling to conceive by donating her eggs.

Cassie Lake, from Tinonee on the Mid North Coast of NSW, wanted to share the joys of parenthood after having a family of her own.

And so she started helping childless families by donating her eggs, and eventually, she went on to become a surrogate for a same-sex couple.
The idea to donate her eggs sprung into mind after she tragically suffered a miscarriage with her fourth baby at 10 weeks pregnant in 2015.

Trudeau says it’s time for Canada to debate decriminalizing fees for surrogate moms

Prime Minister Justin Trudeau says it’s time for society to study the issue of decriminalizing payment for surrogate mothers and sperm or egg donors. (Radio-Canada)

Prime Minister Justin Trudeau says it’s time for Canadian society to wrestle with the controversial issue of paying women to carry other people’s babies.

Calling paid surrogacy an “extremely important issue” that affects many prospective parents, including same-sex and infertile couples, Trudeau said today he expects the debate will draw extreme opinions and emotions.

The government, he said, wants to listen and show respect for all views to “move forward appropriately.”

“I think this is something we need to be thinking about as a society, and when we see the bill I know we will be having a discussion about rights and responsibilities that we share as a society,” he said. “And we will try to see how we can move forward in a reasonable manner.”

Oregon is fertile ground for surrogacy

Source: The Bulletin

New parents are often in awe over their first child, and that is certainly true for Andrew and Courtney Reeves.

The Bend couple marvels at how much their son, Jon, looks like his father. They are amazed at how well he behaves on trips and how he sleeps through most nights. They have already taken their 5-month-old baby on family vacations to Utah and Hawaii.
But Jon’s presence is more a miracle than his good behavior. He was born through surrogacy, an arrangement in which a woman agrees to become pregnant and gives birth to a child for a couple, who will be the child’s parents. The surrogate carries an embryo created in a laboratory using an egg and sperm from the child’s parents.

Once I was married, it took me a while to be sold on having kids — all I wanted to do for many years was to travel, so that’s what my husband and I did. We visited as many states and countries as we possibly could each year, and I was glad to watch my bucket list dwindle as the years wore on. It was only after one particularly adventurous and eye-opening trip to Amsterdam, Cologne, and Brussels that I decided we should start trying for a baby.

UK government launches surrogacy guidance for gay parents after Tom Daley baby news

Tom Daley and Dustin Lance Black

The UK government has said it “supports surrogacy” for “LGBT+ parents wanting to create a family”, issuing guidance on the issue for the first time after British Olympic diver Tom Daley announced he is expecting a child via surrogate.

Daley and husband Dustin Lance Black announced earlier this month that they are expecting their first child together. Though they have not spoken about their route to parenthood, it is believed the pair are using a surrogate, whose identity has not been made public.

Following the news, this week the UK government for the first time published guidance on surrogacy for prospective parents.

Turning Women And Babies Into Merchandise

Source Sky Watch TV –

On March 12, the governor of Washington signed into law a bill amending the state’s Uniform Parentage Act. This act officially permits women to be paid for carrying someone else’s child—in other words, “surrogate motherhood.” Previously, the law only permitted women to be reimbursed for medical and other expenses associated with surrogacy. The amendment, in effect, legalizes commercial surrogacy. So women can now rent out their wombs in Washington State. Sponsors of the bill insisted that the goal of the legislation is to reduce the suffering of infertile couples. But its real-world result will be to further commodify human life and exploit desperate women.

AN Irish woman has told of her heartbreak at discovering she had been born without a vagina, cervix or uterus when she was just 18.

While she was growing up, Rebekah Knight, now 25, from Ballymoney in Antrim, thought she would start her period in her early teens like the rest of her friends.

Rebekah has now written a book to try and help others

But, when she turned 17 and was still waiting, she began to worry that something wasn’t right.

After a string of tests, doctors told her she had a rare condition called Mayer Rokitansky Kuster Hauser (MRKH) syndrome, meaning she was born without a vagina, cervix and uterus.

Win for fairness in recent Surrogacy Decision

Source Public Service Association of NSW

The PSA, working collectively with our colleagues through Unions NSW, is claiming a great win for fairness following the recent publication of a NSW Government Determination on the rights of Employees in relation to altruistic surrogacy and permanent out-of-home care arrangements.

The Determination gives surrogate parents access to the same rights as other parents in relation to leave entitlements following the birth of their child. This formal extension of that entitlement follows years of advocacy by the PSA on a case-by-case basis for parents undertaking altruistic surrogacy arrangements and ensures that in future, no parent has to argue that their family is equal to others.
