Hyderabad: Compensatory surrogacy, and not altruistic surrogacy, was recommended by the Telangana infertility specialists in their discussion and debate at the conference of Indian Fertility Society’s Telangana Chapter on Sunday.

The central government, in its amendment of Surrogacy Regulation Bill 2016, has stated that commercial surrogacy is prohibited and there must be a 16-month insurance coverage provided by the commissioning parents to the surrogate to deal with medical complications. The Founder of IFS, Dr Kuldeep Jain, explained, “Altruistic surrogacy is not possible as, with nuclear families and with near and dear ones not being in the same city, it is not found to be possible. There is only 1 per cent chance for this type of surrogacy as only someone who is really very concerned, free and can do it selflessly for the couple will come forward.”

A 58-year-old woman has given birth to a son after paying £4,500 for IVF in India because she’d been denied treatment in the UK.

Carolyne Hess forked out for the ’embryo adoption’ procedure abroad after the NHS and private clinics at home turned her down for being too old, The Mirror reports.

The single mother gave birth to her son Javed in November after three donor embryos fertilised by a sperm donor were implanted into her womb at the International Fertility Centre in New Delhi in March last year.

She said her eggs came from a 21-year-old Indian woman who liked dancing and her sperm donor was a 6ft tall white American man who worked in IT.

In an attempt to wipe out unauthorised surrogacy centres, the State government on Monday constituted a committee that will keep a check on all surrogacy centres.

The move follows a complaint by a woman named Shubhangi Bhostekar with the Maharashtra State Commission for Protection of Child Rights in April this year. She said her husband, Prakash, a father of two girls, wanted a son, and so he went to a surrogate centre at a private hospital with his mother, claimed he was single and went ahead with the surrogacy.

The MSCPCR issued guidelines this month on regulation of surrogacy for protection of interest of child born of surrogacy, the surrogate mother and to check any malpractices but the commission guidelines does not address the same. Considering the commission is a specialized body constituted under CPCR Act 2005 with the specific mandate to promote the best interest of child through its recommendations following review of existing legislations, policy, such oversight by commission is a glaring omission.

India – Child rights panel wants adherence to norms on surrogacy

The Maharashtra Child Rights Commission has recommended strict implementation of the ICMR’s guidelines for those desiring to have a child through surrogacy.

It has asked the state government to set up a task force to monitor the implementation of guidelines and to tighten the supervision of hospitals facilitating delivery of children through surrogacy.
The Maharashtra State Commission for Protection of Child Rights has also asked people, including actors, desiring a child through surrogacy, surrogate mothers, egg/sperm donors to register themselves with clinics or hospitals, that in-turn have to be registered with an appropriate government authority.

In Feb 2018, there was news that a Pune based woman became a grandmother to twins born via surrogacy methods, using her dead son’s cryo-preserved.
Her life had come to an unexpected standstill when her son had succumbed to cancer in Germany in 2016.

Today, her joy knows no bounds!
As a woman, I cannot but feel happy for this woman and be grateful to the technology that allows us to do this- on the other hand, an IVF specialist, I worry about the moral obligations of posthumous reproduction.
As reproductive technology develops, it opens up several moral and ethical issues in its wake.

Amended Surrogacy Bill to streamline effective regulation of surrogacy practices

New Delhi, March 22: In order to have an effective regulation of surrogacy, prohibit commercial surrogacy and allow altruistic surrogacy to the needy Indian infertile couples, the Union Cabinet chaired by Prime Minister Narendra Modi has given its approval for moving official amendments in the “Surrogacy (Regulation) Bill, 2016”.

The Surrogacy (Regulation) Bill, 2016 proposes to regulate surrogacy in India by establishing National Surrogacy Board at the central level and, State Surrogacy Boards and Appropriate Authorities in the States and Union Territories.

Once the Bill is enacted by the Parliament, the National Surrogacy Board will be constituted. The States and Union Territories shall constitute the State Surrogacy Board and State Appropriate Authorities within three months of the notification by the Central Government.

Tribunal grants maternity leave to govt. servant who begot children through surrogacy

The Central Administrative Tribunal has come to the aid of a woman, working in the Ministry of Law & Justice, who was denied maternity leave as she had begotten her children through surrogacy.

The Tribunal directed the Ministry to sanction 180 days of maternity leave to the woman citing three high court’s verdicts which have held that the commissioning mother is also entitled for grant of maternity leave.

The woman is working as a Personal Assistant in the Legislative Department, Official Language Wing of Ministry of Law & Justice. As she was unable to conceive due to medical issues, she entered into Gestational Surrogacy Agreement with another woman.

Pune: The parents of a 27-year-old man, who died of brain tumour two years ago, used their unmarried son’s cryopreserved semen extracted long before his death to have grandchildren. Fusing the semen with eggs of a matching donor, doctors created embryos and transferred them into a surrogate mother’s womb.

The woman, who incidentally is the man’s aunt, delivered healthy twin baby boys two days ago. Experts, however, have raised questions about the ethics behind the procedure. The man was diagnosed with brain tumour in 2013 while pursuing higher education in Germany.

India – Central Government Approves Maternity Leave For Employees Opting For Surrogacy

For babies born through surrogacy, commissioning mothers can avail paid maternity leave

New Delhi: Central government’s women employees, whose children are born through surrogacy, will now be entitled to maternity leave, according to an official order of the personnel ministry.

The employees can avail of paid maternity leaves up to 26 weeks (about 180 days).

The ministry has written to all central government departments about a 2015 Delhi High Court order on this issue.
